Privacy Policy
Effective: February 7, 2022
Thank you for visiting our website. Our goal is to create an online experience that facilitates collaboration. This Privacy Policy outlines how we collect, use, and handle your personal information when you use our websites, software, and services (“Services”).
What & Why
We collect and use the following information to provide, improve, and protect our Services:
Account Information: We collect and associate information with your account, such as your name, email address, phone number, and physical address, when you sign up for an account, subscribe to our newsletter, or request an appointment. Some Services allow you to access your information through other service providers.
Your Content: Our Services are designed to enable you to store your files, documents, comments, messages, etc. (“Your Content”), collaborate with others, and work across multiple devices. To facilitate this, we store, process, and transmit Your Content and related information, such as profile details, file size, upload time, collaborators, and usage activity. Our Services provide options for sharing Your Content.
Contacts: You may choose to provide us access to your contacts (such as your spouse or colleagues) to facilitate sharing and collaboration on Your Content. We store these contacts on our servers for your use.
Usage Information: We collect data on how you use our Services, including actions taken within your account (e.g., sharing, viewing, moving files). This information helps us improve our Services, develop new features, and protect users.
Cookies and Other Technologies: We use cookies and similar technologies to provide, enhance, protect, and promote our Services. For instance, cookies help remember your username for subsequent visits and understand how you interact with our Services. You can configure your browser to reject cookies, but this may limit your use of the Services.
Marketing: We offer some Services free of charge, funded by users who upgrade to paid versions. If you register for our free Services, we may send you information about the firm or tax and accounting tips, where permissible. You can opt-out of these communications at any time by clicking the ‘unsubscribe’ link in any email.
We may contact individuals who do not have an account. For recipients in the EU, we or a third party will obtain consent before contacting you. If you receive an email from us and no longer wish to be contacted, you can unsubscribe via the message itself.
Bases for Processing Your Data: We collect and use personal data to provide you with reliable and secure Services and for our legitimate business interests. If we process your data for other purposes, we will seek your consent or require our partners to do so.
With Whom
We may share information as outlined below, but we do not sell it to advertisers or other third parties.
Service Providers: We use trusted third parties (e.g., customer support, eSign, and IT service providers) to help us deliver, improve, protect, and promote our Services. These third parties access your information only to perform tasks on our behalf in compliance with this Privacy Policy. We remain responsible for their handling of your information per our instructions. See our third-party vendors list below.
Other Users: Our Services display information like your name, profile picture, device, and email address to other users in areas like your user profile and sharing notifications. You can share Your Content with other users if you choose. If you register with an email address associated with your employer or organization, we may help collaborators and administrators find you by making some of your basic information visible to other users on the same domain. This helps you connect with workspaces you can join and allows others to share files and folders with you.
Workspace Admins: If you use a workspace, your administrator may access and control your workspace account. Refer to your organization’s policies if you have questions. If you interact with a workspace user (e.g., by joining a shared folder), members of that organization may see your name, email address, profile picture, and IP address at the time of interaction.
Legal and Public Interest: We may disclose your information to third parties if we determine that such disclosure is necessary to (a) comply with laws, regulations, or legal processes; (b) protect individuals from death or serious injury; (c) prevent fraud or abuse of our platform or users; (d) protect our rights, property, or safety; or (e) perform tasks in the public interest.
We are committed to protecting your data and believe it should receive the same legal protections regardless of where it is stored. We will follow our Government Request Policies when responding to government requests for your data, which include being transparent, fighting blanket requests, protecting all users, and providing trusted services.
How
Security: We have a team dedicated to keeping your information secure and testing for vulnerabilities. We continually develop features to keep your information safe, such as blocking repeated login attempts, encrypting files at rest, and alerting you when new devices and apps are linked to your account. Automated technologies help detect abusive behavior and content.
User Controls: You can access, amend, download, and delete your personal information by logging into your account.
Retention: We retain the information you store on our Services for as long as your account exists or as needed to provide the Services. If you delete your account, we will initiate deletion of this information after 30 days. Note that there might be some latency in deleting this information from our servers and backup storage, and we may retain it to comply with legal obligations, resolve disputes, or enforce agreements.
Where
Global Operations: To provide our Services, we may store, process, and transmit information in the United States and other locations worldwide, including outside your country. Information may also be stored locally on devices you use to access the Services.
EU-U.S. and Swiss-U.S. Privacy Shield: For data transfers from the European Union, European Economic Area, and Switzerland, we rely on legal mechanisms, including contracts with customers and affiliates. We comply with the EU-U.S. and Swiss-U.S. Privacy Shield Frameworks regarding the collection, use, and retention of personal information transferred to the United States. We are subject to oversight by the U.S. Federal Trade Commission. JAMS is the U.S.-based organization responsible for reviewing and resolving complaints about our Privacy Shield compliance. If you have a complaint, contact us at privacy@lindamagalona.com. If you are not satisfied with our response, contact JAMS at https://www.jamsadr.com/eu-us-privacy-shield. If JAMS cannot resolve your complaint, you may be entitled to binding arbitration under Privacy Shield principles.
Changes
If we are involved in a reorganization, merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.
We may revise this Privacy Policy periodically and will post the latest version on our website. If a revision significantly reduces your rights, we will notify you.
